TAKE NOTICE ACCORDING TO THE TERMS OF THE LEASE:
B. LATE PAYMENT. If the rental payment or any other sum due to Landlord is received by Landlord after 5:00 p.m. on the fifth (5) day of any calendar month, a late charge of Forty-five Dollars ($45), payable with money order or certified checks only, will be assessed against Tenant. Holidays are included in this time frame. Tenant also will be assessed court costs and reasonable attorneys’ fees if any payment is received by Landlord after the 10th (tenth) day of the month in which Landlord has turned over Tenant’s account to an attorney to institute legal action. Any late payment received by the Landlord or Landlord’s Attorney will be accepted with reservation and will not affect Landlord’s right to institute or proceed with legal action against Tenant to recover delinquent Rent, other sums due Landlord, and possession of the Dwelling Unit. Landlord reserves the right to require payments be made to the attorney once legal action has been initiated.
C. RETURNED CHECKS OR FAILED ELECTRONIC TRANSFERS. Landlord reserves the right to require that all monthly installments be made by money order or certified funds, or to require automatic or electronic payment. Checks that are returned for insufficient funds or otherwise, or failed electronic funds transfer, will result in the following charges, in addition to the late charges specified herein and the face amount of the payment, and all other amounts recoverable by Landlord pursuant to this Lease or by law: (i) a reimbursement of any fee charged by the bank; (ii) a processing fee in the amount of $35; (iii) legal interest from the date of the check or transfer; and (iv) a civil recovery not to exceed $250.
